WEDNESDAY, 16 JULY 2003
THE COMMISSIONER: The Commission will under its general powers, that is 111(1)(t), and if necessary rely on section 111(1)(b) issue an order that the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union that are parties to dispute No 2553 of 2003 which is a section 99 notification of an industrial dispute and also parties to C2554 of 2003 which is a section 127(2) application and which are also subject to an application under section 170MW, power of the Commission to suspend or terminate the bargaining period in BP 5723 of 2003, that the union and its officers and members are not to engage or encourage any industrial action by way of rolling stoppages, bans or limitations against ETRS Pty Limited from 6.30 today, 16 July, until such time as the Commission reconvenes for the purposes of hearing arguments on behalf of the applicant in BP 5723 of 2003, that is, ETRS Pty Limited, if they wish to press their section 170MW application, or if the union in this matter wishes to argue that the orders so issued from today should be lifted.

The Commission would also order that the parties enter into meaningful discussions between today and a report-back to the Commission by way of conference at 1.00 pm on Tuesday, 22 July. At that time the Commission will make itself available to assist the parties to progress the negotiations concerning a section 170LJ agreement. Are the parties clear on what is being put?
