MR M. MEAD: I appear on behalf the Australian Industry Group.

THE VICE PRESIDENT: I have received correspondence from the Queensland Chamber of Commerce and Industry advising that they have no interest in the award and hence will not appearing in relation to the matter. Yes, Ms Piercy?

MS PIERCY: Yes, thank you, your Honour. Your Honour, the parties have been advised of today's hearing, I have a statement which sets out that they were sent a copy of the hearing notice and the - actually a draft order for discussion and they were sent on 2 July 2003 and I would like to hand that to your Honour for the Commission's files.

THE VICE PRESIDENT: All right, yes, thank you.

MS PIERCY: Your Honour, the union has had discussions with the parties in regard to this matter and have reached agreement with all but one party, that is the New South Wales employer, Mr Mead who is representing them today. The union is seeking to have at least a week if we could have this matter put over for a week and - to reach an agreed position to bring back to the Commission.

THE VICE PRESIDENT: Okay, bear with me for a moment, Ms Piercy. You are content with that, I take it, Mr Mead?

MR MEAD: Yes, thank you, your Honour.

THE VICE PRESIDENT: Thank you. 4.30 pm on Monday 25 August, would that give you sufficient time?

MS PIERCY: Is there any matters - any availability earlier?

THE VICE PRESIDENT: Sure.

MR MEAD: Your Honour?

THE VICE PRESIDENT: Yes.

MR MEAD: If it would be convenient, would the 26th be okay, I'm interstate until on the 25th. I maybe be able to get someone else from my office to attend the hearing but - - -

THE VICE PRESIDENT: That is fine, I will just try and see if I have got - I don't want to come to Sydney just for this exercise. What about 12 o'clock on - well, say 12.30 on Wednesday the 14th, does that suit you?

MS PIERCY: 12.30?

THE VICE PRESIDENT: Yes. Okay with both?

MR MEAD: Yes, thank you.

MS PIERCY: Thank you, yes.

THE VICE PRESIDENT: All right. If there is any - Ms Piercy, if as a result of your discussions with Mr Mead, there is a change to the draft order, if you can undertake to advise all of the other interested parties of that change, so they are aware of it prior to the hearing. I mean it is unlikely that if it is a concession to - if a concessions is made to one employer that any other employer is going to particularly object to it. But I think it would be better if they are advised as to the precise nature of what you are seeking. Okay?
