MR R. WAINWRIGHT: I appear for the Construction, Forestry, Mining and Energy Union.

MR D. SULLIVAN: I appear for the Australian Industry Group on behalf of the Company.

THE SENIOR DEPUTY PRESIDENT: Yes, Mr Wainwright.

MR WAINWRIGHT: Your Honour, I think the AIG have lodged this application but on my perusal of the paperwork each of the statutory tests have been met. This is an agreement that covers the civil work of the company and will supplement the previous agreement that has been certified for their commercial construction work. Your Honour, the CFMEU can confirm that we have at least one member employed in this part of the company and we are entitled to represent the industrial interests of that member. We further submit that the requirements of section 170LJ and section 170LT have been met and we seek certification.

MR SULLIVAN: Yes, your Honour, we support our application - in the words of the union - but there was - I believe the company stat dec had a couple of questions unanswered for which we have now got a replacement stat dec for the records.
