MR S. RAIMONDO: I appear on behalf of the Shop, Distributive and Allied Employees Association.

THE DEPUTY PRESIDENT: Would you like to proceed to put a submission, perhaps?

MR RAIMONDO: Your Honour, this is an application under section 170LL of the Workplace Relations Act to certify the SDA-Domino's Pizza Agreement No 14 2003. This agreement is identical in the terms and conditions, as well as in the terms of the expiry date, as the previous Domino's agreements that have been certified by the Commission. The original agreement was certified by Vice President Ross on 8 October 2001. The agreement, like the previous, is to expire on 30 July 2004.

The grievance procedure is located at clause 28 of the agreement and we rely upon the statutory declaration signed by Joe De Bruyn, the National Secretary of the SDA, and we would seek to have the agreement certified effective from today's date. If there are no further questions, then if it please the Commission.

THE DEPUTY PRESIDENT: Yes, thank you very much for that. I note that at clause 7.3 of the statutory declaration there is quite a substantial list of changes to the award. I note firstly that I have examined those changes in previous matters in some detail, in particular, an analysis of those changes is kept on file, and I have accepted that an agreement in that form meets the requirements of the no disadvantage test and I make the same judgment in this present matter. On the basis of the submissions put and the statutory declarations filed, I will certify the agreement as sought by you. Thank you very much.
