THE VICE PRESIDENT: Is this agreement in respect of a single business or part of a single business?

MS COATE: It is for a single business.

THE VICE PRESIDENT: Okay, thank you. Ms Coate, I am not sure if you were present when I put some questions going to the relevant statutory test to Mr Borenstein at 10.45. Were you here for that?

MS COATE: I was here for that, Vice President.

THE VICE PRESIDENT: Okay. Rather than have me repeat those, do you adopt the answers that Mr Borenstein gave to the questions I put to him about the relevant statutory tests?

MS COATE: I do.

THE VICE PRESIDENT: Thank you. And, Mr Fitton, do you do that also in relation to this matter?

MR FITTON: I also do, your Honour.

THE VICE PRESIDENT: All right. Well, on the basis of the adoption of those answers and the material filed in support of the application I am satisfied the application meets the relevant statutory tests and I will issue a certificate for the certification of the agreement.
