THE DEPUTY PRESIDENT: This is an application pursuant to section 170MH of the Workplace Relations Act to terminate a certified agreement. The agreement is known as Kellaway Wall and Ceiling Contractors Pty Limited Enterprise Agreement 2000-2003. The termination is by consent. It is past its expiry date. The parties to the agreement being the CFMEU and Kellaway Wall and ceiling Contractors Pty Limited both consent to the agreement being terminated and neither is in attendance but have provided faxes agreeing to the termination in their absence.

Accordingly the agreement known as the Kellaway Wall and Ceiling Contractors Pty Limited Enterprise Agreement 2000-2003 will be set aside and terminated effective from today's date.
