Although they haven't indicated to us, I understand they've advised your associate they intend to appear. We already have a letter from them, but I imagine that we'll need to leave that until midday, when they're scheduled.

MS LEWIS: We had a letter from them indicating consent, but I understand that after we gave them the details of today's hearing, they contacted your associate and advised of their intention to appear by hook-up in Sydney.

MS LEWIS: Thank you, Commissioner. This is an application to vary the Unisys Payment Service Award 2000 by varying the award salary rates and the salary related allowances, as per our draft order. The application includes a specific commitment as to the absorption of the increase at clauses 20.5.1 and 20.5.2 of the award, which appear at paragraphs 6 and 7 of our draft order, and the FSU also gives a commitment to absorb the increase. The salary rates in this award were last varied from the first full pay period on or after 11 September last year to give effect to the May 2002 Safety Net decision.

Commissioner, our application also seeks to give effect to the increase in the supported minimum wage rate. A copy of our draft application to vary, the draft order, and a wages and allowances methodology worksheet were sent to the employer by a facsimile on 17 July for comment, and I refer you to document 10 in the faxed documents, Commissioner - - -

THE COMMISSIONER: Yes, Ms Lewis; I have it.

MS LEWIS: - - - where you will see a letter dated 1 August from Ms Lennon on behalf of Unisys indicating that Unisys consents to the application as detailed in the draft order. On 4 September a letter was faxed to Mr Welfare at Unisys advising of the details of today's hearing and attaching a copy of our application to vary and the draft order, both of which were identical in terms to the document provided earlier to the company and to which they had consented. We therefore seek that you grant our application and that the order take effect from the first full pay period on or after 11 September 2003, which is the 12 month anniversary from the date of the last increase. If it please the Commission.

THE COMMISSIONER: Good. Thanks, Ms Lewis. Ms Tooth and Ms Lennon, I have documentation before me regarding this matter, but you have a separate appearance so I'll hear from you, if you like.

MS TOOTH: Thank you, Commissioner. Yes, we absolutely do consent to the order as it has been presented by the FSU. Mr Welfare, to whom the fax was sent - I've actually replaced him in his role, so that is why I am here and not him. But, yes, we absolutely do consent to the order as it was presented.

THE COMMISSIONER: Look, on the basis of the submissions of both the applicant and the respondents, as well as the documentation that is before me in respect of this matter, the Commission approves the draft order as presented in respect of this matter. An order will issue later today confirming the operation of this order, effective as from 11 September 2003. Can I thank you for your submissions on this matter.
