THE VICE PRESIDENT: Appearances are as before. I notice there are additional people coming but that's fine they can be identified as necessary. So Mr Thompson for the CPSU, Mr Hatter and Mr Lamrock in attendance, Mr Smith for the ABC, Ms Bate, Mr Naylor and Mr Radoczy and Mr Turner. Shall we move straight into conference? Is there anything the parties wish to place on the record?

MR THOMPSON: Not at the moment.

MR SMITH: The only thing I would just draw to the Commission's attention is the section 99 dispute notification. That arose out of a dispute settling procedure under section 170LW.

THE VICE PRESIDENT: Is there any particular reason for notifying as a section 99 dispute, Mr Smith?

MR SMITH: It may have been an error on our part, your Honour. We searched high and low through the web site and we did in fact lodge it under form 47, rule 66, which I understood to be dispute settling procedure in certified agreements.

THE VICE PRESIDENT: Yes, that's exactly what you have done that's been made up as a section 99 file. So we treat this as it has in fact been notified which is a section 170LW notification.
