THE VICE PRESIDENT: Thank you. Mr Donnelly, were you present when I put a series of questions to Mr Lean about the relevant statutory test in the first matter that was dealt with.

MR DONNELLY: I was, sir.

THE VICE PRESIDENT: You were?

MR DONNELLY: Yes, I was, sir.

THE VICE PRESIDENT: I appreciate the agreements are different and there is a different underpinning award and some of the clauses are different, but apart from those differences, would you adopt the answers that Mr Lean gave to the questions that I put in respect of this particular matter?

MR DONNELLY: Yes, I would, sir.

THE VICE PRESIDENT: All right. And Mr Gevers, were you present also and do you adopt those answers?

MR GEVERS: Yes, I was, and yes, I do.

THE VICE PRESIDENT: All right. Well, on the basis of that and the statutory declarations, I am satisfied that the relevant tests have been met and I will issue a certificate certifying the agreement. Thank you, Mr Donnelly.
