MR B. SHAW: If the Commission pleases, I seek leave to appear for the applicant company.

THE SENIOR DEPUTY PRESIDENT: Leave is granted, Mr Shaw.

MR SHAW: Your Honour, this is a second attempt at getting an agreement certified. From the first occasion you will recall the agreement being made before the expiry of 14 days after the notice had been given. On this occasion you will see from the statutory declaration the employer has made it absolutely certain, this time they were leaving it nearly a month from one to the other. The agreement itself has also been tidied up. I took the opportunity of actually, as the employer had gone ahead and got a draft thing I sent out to you for approval, agreed to by his employees.

I have taken the time to completely tidy the agreement up. I mentioned to your associate before that I have spent most of the day with Mr Maddison before Commissioner Grainger and when I asked him if he would be coming along here today he suggested that I probably got it right the second time. He didn't say he even knew we would get it right the second time fortunately. Based on the material that has been filed and subject to any questions the Commission might have, I would ask that the agreement be certified.

THE SENIOR DEPUTY PRESIDENT: Yes, thank you, Mr Shaw. I have no questions. This is an application for certification of an agreement to be known as the MKH Industries Pty Ltd Enterprise Agreement 2003-2006. On the basis of the statutory declarations that have been filed and the submissions made today, I am of the view that having regard to the applicable provisions of the Act I am inclined to certify the agreement. An appropriate certification will therefore be issued as soon as possible. The matter is adjourned on that basis.
