MS F. WALLISS: I appear on behalf of Target Australia Pty Ltd and with me is MS S. JOHNSTON.

THE DEPUTY PRESIDENT: Thanks Ms Walliss. Ms Burnley?

MS BURNLEY: Yes, your Honour, this is an application by the parties to have registered the Target Retail Agreement 2003. It is an agreement that the parties have entered into after consultation with their employees and it is a follow up agreement to the previous registered certified agreement and will replace that retail agreement. The SDA has supplied a statutory declaration to the Commission and we would rely upon that in seeking to certify this agreement. If it pleases the Commission.

MS WALLISS: Your Honour, we also agree making application for certification under section 170LJ. The agreement is the Target Retail Agreement 2003. All the appropriate documentation as required by rule 48, that is, the form R27 and R28 have been filed with the registry and I seek to rely on the information contained within these statutory declarations. Your Honour, the current agreement expires today and it is the submission of Target Australia Pty Ltd that the retail agreement be certified as operative of tomorrow, 1 February, if possible.

THE DEPUTY PRESIDENT: Ms Burnley, you are in agreement with that effective date?

MS BURNLEY: Yes, your Honour.

THE DEPUTY PRESIDENT: Once again I am satisfied that this application and its supporting documentation complies with all relevant requirements of the Act allowing for this agreement to be certified and I will certify the agreement with effect from tomorrow, 1 February.

The agreement will expire on 31 January 2006. And that is adjourned, thank you.
