MS S. BURNLEY: If the Commission pleases I appear on behalf of the Shop Distributive and Allied Employees' Association.

THE SENIOR DEPUTY PRESIDENT: Ms Burnley, this matter has been called on because the Daimaru Australia Pty Ltd Retail and Wholesale Award is still in existence, and Daimaru has been out of existence for some time. It seemed to the Commission that it may be appropriate to set the award aside, hence we advised the relevant parties. Daimaru no longer being contactable easily we contacted the Australia Retailers Association, who have written to us indicating it is not a member of the Association and has not traded in the country for some time. They are not aware where the business exists or if anybody represents Daimaru Australia's interest.

MS BURNLEY: Yes, your Honour. We forwarded a letter yesterday as well indicating it is probably appropriate to set this award aside.

THE SENIOR DEPUTY PRESIDENT: Yes.

MS BURNLEY: It was maintained at some time there because there was an agreement to be certified just prior to Daimaru closing, but yes, it would be appropriate now for the award to be set aside, if it pleases the Commission.

THE SENIOR DEPUTY PRESIDENT: Very well. Well, I am satisfied that I should set the award covering Daimaru Australia Pty Ltd Retail and Wholesale 1996-1999 aside, and I will do so. I will now adjourn.
