THE COMMISSIONER: I note that Mr G. ANDERSON appears for the LHMU with MR P.J. RYAN and MR N. SAMIOS from Chubb. Mr Anderson?

MR ANDERSON: Thank you, Commissioner. Commissioner, the LHMU seeks to be bound in respect of this enterprise agreement at the Fairbairn Air Base. We faxed to the Commission a letter and a copy of the request from our member asking that we seek to be bound under section 170N(3) of the Act. Commissioner, as regards the status of our member, I would seek to hand up a copy of the membership records which shows that the member in question is in fact a financial member.

THE COMMISSIONER: Has Mr Ryan seen this?

MR ANDERSON: No, Commissioner. Commissioner, I would seek that that information remain confidential.

THE COMMISSIONER: Well, we make it confidential to the parties in this Commission.

MR ANDERSON: Thank you, Commissioner.

THE COMMISSIONER: Show it to Mr Ryan to sight and nothing else.

MR RYAN: Yes, thank you.

THE COMMISSIONER: Do you have any submissions, Mr Ryan?

MR RYAN: Commissioner, having addressed the requirements of the Act under section 170N(3) the company does not oppose the LHMU's application.

THE COMMISSIONER: Very sensible. Well, the Commission will vary AG2002/6396 to include the Australian Liquor Hospitality Miscellaneous Workers Union as a party to that agreement and accordingly that agreement is certified from today's date and remains in force until 17 December 2005. Thank you, gentlemen, the Commission is adjourned.
