THE VICE PRESIDENT: Can I have the appearances, please.

MR N. KEATS: Good morning, your Honour, I seek leave to appear on behalf of the Textile Clothing and Footwear Union of Australia. I also mention the appearance of Ms Brooks who has previously appeared on these matters on behalf of their respondent members of Australian Business Industrial.

THE VICE PRESIDENT: Leave is granted, Mr Keats. What do you want me to do with Ms Brooks?

MR KEATS: I just want to mention that Ms Brooks consents to the document that I'm about to hand up as being a proper list of respondents that should be added to the Textile Industry Award, and if the Commission is minded to add these respondents to schedule A that the other roping-in award should be set aside that were part of these proceedings.

THE VICE PRESIDENT: Thank you. I've also received correspondence from Mr Halls of AIG indicating that they have perused your final list and they support the variations. Thank you, Mr Keats. I'll mark that exhibit as exhibit TCFUA1.

THE VICE PRESIDENT: On the basis of the agreed position set in exhibit TCFUA 1, what I propose to do is vary the respondency list in the Textile Industry Award 2000 to include each of the employers set out in exhibit TCFUA. I make that variation in part settlement of all of the disputes that are listed before me this morning and further I will set aside the relevant roping-in award, I think its roping-in award number three.
