THE DEPUTY PRESIDENT: AG2003/896 is an application pursuant to section 170LJ of the Workplace Relations Act for certification of an agreement to be known as the Smorgon ARC/AWU Tasmanian Agreement 2003. Neither of the parties are in attendance, having been advised that there are no queries within the agreement and it can be certified in their absence. The only question raised was that the application was some days out of time. This was due, according to the applicants, because the agreement was lodged with a drafting error which identified the wrong individual as the union secretary on the signature page.

However, there has been no industrial action and the make-up of the employees remains the same as those who voted on the agreement. Accordingly, an order will issue to take effect from today's date and remain in force until 30 June 2005. The agreement, however, came into effect from 1 January 2003. That agreement is certified.
