THE COMMISSIONER: Thank you, now is your chance to make any application you like. Nobody is here opposing you. Can we set this appendix aside?

MR TRINDADE: Yes, Commissioner, it would certainly be our submission that you can. We would probably just like to say that the transitional arrangements have, from my perspective, been very successful and we thank the Commission for the assistance in implementing those transitional arrangements. There are approximately in excess of 200 employees who came within the ambit of those transitional arrangements. There was not one piece of disputation that came before this Commission in respect of those transitional arrangements and we would say that that is a reflection of the way that it was handled and also the way that the framework was designed to give a fair and equitable process which, we say, has done the work it was intended to do, using the Commissioner's wording from the last occasion and simply should be removed.

THE COMMISSIONER: Thank you, very well, I will take the action that I foreshadowed I would do on the last occasion and the variation will occur from today. I also hand down to you, Mr Trindade, a copy of some correspondence that I received from your client in relation to the matter in the terms of ..... you had a read of it. Thank you, the matter is adjourned sine die.
