THE DEPUTY PRESIDENT: This is an application pursuant to section 170LL of the Workplace Relations Act for certification of an agreement between National Personnel Pty Limited and the Maritime Union of Australia. The agreement will be known as the Maritime Union of Australia and National Personnel - TT-Line Enterprise Agreement for New South Wales and Tasmania 2004. The agreement covers those employees of National Personnel covered by the classifications found in the agreement, whether members of the Maritime Union or not.

Neither of the parties are in attendance and we have been advised there were no specific queries in respect to the agreement. Each has provided a fax seeking certification in their absence. They have also provided statutory declarations, and having read those I am satisfied the requirements of the Act have been met. This is new work for this organisation in Tasmania and in New South Wales and covers the service of the Spirit of Tasmania vessels I, II and III. The agreement can be certified and an order will issue to take effect from today's date and remain in force until 8 January 2007. The agreement, however, came into effect on 9 January 2004. That agreement can be certified.
