THE COMMISSIONER: Thanks, Mr Brajevic. Now, has there been any discussion about the programming of this matter or do you want to adjourn into conference to settle the programming details.

THE COMMISSIONER: I have conferred with the parties in relation to the programming of this matter. To begin, it is appropriate to record that Vice President Lawler has found that conciliation is at an end in relation to matter C2004/1393. The other matters listed, which were 2003/5929 and 2003/5927, they will no longer be listed. There is agreement that no further action be taken on those two files.

In relation to the notification of an industrial dispute the program will be as follows: on or before 16 April, the CEPU will lodge in the Australian Industrial Registry and file on Testra an outline of submissions and any witness statements together with a draft order. On or before 28 April, Telstra will lodge in the Australian Industrial Registry and serve upon the CEPU any outline of submissions and any witness statements it proposes to rely upon. The matter will be listed in Sydney for the week beginning 3 May and 10 and 11 May will also be set aside in case there are any additional witnesses.
