MS JASTRZEBSKI: Your Honour, it is an application under Division 3, Section 170LS and the first issue is the late lodgment. This agreement is one of the Geelong group of agreements and although the vote was conducted on 5 June through a fairly serious administrative error, the application wasn't made until 26 November. There were a series of new votes conducted by local shop stewards and the JCB Contracting Agreement was re-endorsed by the members just prior to the lodgment date. There has been no change to the work force and they are very keen to see their agreement certified. Aside from the late application, we believe that the requirements of the Act have been met in terms of the process and we would ask that this be certified. If the Commission pleases.

THE SENIOR DEPUTY PRESIDENT: Having regard to the material contained on the file in this matter and the submissions put to me I am satisfied I should grant the necessary extension of time for the lodgment of the application in this matter. I am also satisfied I should certify the agreement known as the JCB Contracting Collective Bargaining Agreement 2003. I am satisfied that to do so would be consistent with the requirements of the Act and regulations and certification of the agreement will come into force from today's date and remain in force until 31 March 2006.
