THE DEPUTY PRESIDENT: This is an application pursuant to section 170LJ of the Workplace Relations Act for certification of an agreement to be known as The Cornwall Coal Company No Liability Certified Agreement 2003. The parties to the agreement are the Cornwall Coal Company No Liability, the CEPU, the AMWU, the CFMEU, APESMA and the employees of the Cornwall Coal Company No Liability who are members or not of any of those unions and are covered by the classifications found therein.

I note that the agreement talks about only employees of the company who are members of the union. The intent is the agreement applies to all employees covered by the classifications, be they members of the union or not. None of the parties are in attendance, each has provided documentation seeking certification in their absence, having been advised that there were no queries in respect to the content of the conditions in the agreement.

Accordingly, I am satisfied the agreement can be certified. The parties have provided the necessary statutory declarations and the agreement will come into effect from today's date and will remain in force until 11 May 2007. That agreement is hereby certified.
