THE COMMISSIONER: Yes, Mr Butler.

MR BUTLER: Commissioner, first of all I indicate the time, date and place of hearing and draft orders have been served on the parties and there should be a statement of service.

THE COMMISSIONER: Yes, I have all that, thank you very much. Very efficient.

MR BUTLER: If I can now formally table the draft order?

MR BUTLER: Commissioner, clause (a)(i) is the increases to weekly rates of pay in accordance with the decision. Clause (a)(ii), the new hourly rates of part time employees and clause (a)(iii) is schedule of rates for casual employees. Clause (a)(iv) on page 3 of the order is the absorption commitment that is required under the principles and the Association makes that formal commitment here today on the record.

THE COMMISSIONER: Yes.

MR BUTLER: And the proposed operative date is on or after 3 July 2004. Just one matter, Commissioner, I discovered just before I was due to come here this morning is that we neglected to include in the proposed variation the variation to the allowances in clause 28. Clause 28 is use of motor vehicle. I am in your hands as to whether or not I should lodge a separate application or whether I could amend the draft order, seek agreement from the employers and hand it back to the Commission within the seven days.

THE COMMISSIONER: That is probably the easier course, isn't it?

MR BUTLER: Yes.

THE COMMISSIONER: Ms Pascalis.

MS PASCALIS: The Australian Industry Group has checked the draft order submitted and are not opposed to it and neither oppose to a seven day delay.

THE COMMISSIONER: Excellent. All right. I will vary the award, vary the Telecommunications Industry (Professional Employees) Award 2002 to increase wages and allowances, or singular allowance, is it?

MR BUTLER: Yes.

THE COMMISSIONER: It is the motor vehicle allowance. To increase wages and the motor vehicle allowance for the safety net review wages May 2004 decision which was issued on 5 May 2004 in print 002004. The Australian Industry Group which has appeared in these proceedings consents to the variation and also consents to a proposal put forward by Mr Butler that he calculate the vehicle allowance and circulate that to the respondents to see whether or not there is any objection as to the calculation and that can be forwarded to my office as soon as possible and one order will issue varying all the matters. Thank you. The matter is adjourned sine die.
