MR D. GIBSON: Commissioner, I appear on behalf of the Victorian Railway Company Pty Limited.

MR V. MOORE: I am from the Rail, Tram and Bus Union.

THE COMMISSIONER: Are there any submissions to be made in respect of this agreement? Mr Gibson.

MR GIBSON: Mr Commissioner, there is no material change in the agreement. The wage scale schedules have been brought into line with other like agreements. Clause 10.1 of the agreement had a small amendment re job offers which was brought into being because of the possible termination of the franchise agreement West Coast Railway operates the trains under, and a flat dollar test rate in clause 15.7 was inserted, all of which really to the union benefit.

THE COMMISSIONER: Yes. Thanks, Mr Gibson. Mr Moore.

MR MOORE: Yes, Mr Commissioner. We notified our members in relation to the EBA. We have conducted on the job meetings in relation to the enterprise bargaining agreement. They have all been well-attended meetings and they have been formally endorsed by the membership.

THE COMMISSIONER: Yes. Thanks, Mr Moore. Well, pursuant to section 170LT of the Workplace Relations Act 1996 the Commission certifies the said agreement. The agreement will come into force from today's date, 28 June 2004 and will remain in force until 30 June 2006. The Commission is adjourned. Thanks, gentlemen.
