THE SENIOR DEPUTY PRESIDENT: Good morning, I'll take appearances please.

MS. L. BENNETT: I appear for the APESMA.

THE SENIOR DEPUTY PRESIDENT: Yes thank you Ms Bennett. Can I note for the record that this is an application pursuant to 113 of the Workplace Relations Act to give effect to the safety net review Full Bench decision 2004. I note the time that is past 10.20 and the matter was listed for 10.00 am. It is an application made by the AMWU. I am satisfied as to service with respect to the company and CEPU and the NUW but note that only Ms Bennett from APESMA is here this morning.

We've tried unsuccessfully to contact the applicant. So Ms Bennett did you want to put anything on the record, at this stage, not being the applicant?

MS BENNETT: Thank you your Honour. The only thing that I would like to put on the record is that given the fact that the applicant hasn't attended we would respect of the Commission, if possible, that we seek an adjournment and I undertake to follow up with the company in respect of this hearing and I request that they perhaps call you and speak to you about their lack of attendance today and perhaps talk with you how the issue can be furthered. Thank you your Honour.

THE SENIOR DEPUTY PRESIDENT: Thank you. I think I've got no choice but to adjourn the matter. We haven't been notified by telephone by the AMWU representative. I don't want to inconvenience your organisation, and you personally, Ms Bennett, any further. If it would assist I would be happy for the draft order to be circulated to your organisation and if you consent to it, if you could notify that together with the commitment as to absorption of over award payments in writing, you may be excused from any further hearing. Of course you are welcome to attend if you wish to.

I would expect that this matter be re-listed. It may not be re-listed before me because I am going on leave for several weeks but I might endeavour to see whether we can resolve it by the end of this week. So thank you for your attendance and my apologies again.
