MS ILIAS: Your Honour this is an application made pursuant to section 111(1)(b) of the Workplace Relations Act of 1996 for a roping award. There is a part settlement of dispute finding against Kids Camps Limited and Another in matter number C2004/4083. The notice of hearing was forwarded to the parties by registered mail on 28 July 2004 advising of the union's intention of roping in. Attached with the letter was a draft roping in award which was filed with the Melbourne registry on 29 July 2004.

The draft order of what the union is seeking in this matter is to be known as the Children's Services (Victoria) (Roping in No 3) Award 2004 with one slight amendment your Honour. In relation to Kids Camps in Keilor the number 16 should actually read 26. That is just actually a typographical error and I am more than happy to provide your Honour with a draft order to reflect that change either by email or fax, whatever your preference is.

MS ILIAS: We would be seeking this order to operate on the first pay period on or after 13 August 2004 for a period of six months. The union had received mail or correspondence from Mr Michelle Rutherford, the Human Resource Manager of Kids Camps Australia Pty Limited consenting to the roping in for all the Kids Camps centres as per the schedule of respondents on the attached draft order.

Your associate informed me that another letter has been forwarded to your chambers in respect to Fern Gully Child Care Centre also consenting to the roping in your Honour. Just to say your Honour that the draft award complies with 89(a) of the Act as well as the first award principles and the safety net review decision of PR00/2004. The union commends the application to the Commission. Thank you your Honour.
