TRANSCRIPT OF PROCEEDINGS
O/N 8319
AUSTRALIAN INDUSTRIAL
RELATIONS COMMISSION
DEPUTY PRESIDENT HAMILTON
C2004/5214
SPRINKLER PIPE FITTERS'
AWARD 1998
Application under section 113 of the Act
by the Communications, Electrical, Electronic,
Energy, Information, Postal, Plumbing and
Allied Services Union of Australia to vary
the above award re Safety Net Review - May
2004 (PR002004)
MELBOURNE
11.04 AM, WEDNESDAY, 25 AUGUST 2004
PN1
MR J. COONEY: I appear for the CEPU Plumbing Division.
PN2
MS C. COATE: I appear for the National Fire Industry Association.
PN3
MR C. HARNATH: I appear for the Master Plumbers and Mechanical Services Association of Australia.
PN4
THE DEPUTY PRESIDENT: So to save time, Mr Cooney, the position is exactly the same as the previous awards is it, using the established methodology and no corrections to the order are needed, is that correct?
PN5
MR COONEY: Correct, your Honour, and the union has adjusted the amounts for $19. In accordance with PR002004 it gives the relevant commitment clause at clause 11.1.1 and it would seek an operative date of 29 August 2004 which is 12 months since the previous increase.
PN6
THE DEPUTY PRESIDENT: There's no issues in this award, are there?
PN7
MR COONEY: No, your Honour.
PN8
THE DEPUTY PRESIDENT: Right. Who is next?
PN9
MS COATE: We have had the application before us for some time. We've had an opportunity to check the figures and we have no difficulty with the application proceeding.
PN10
THE DEPUTY PRESIDENT: Thank you.
PN11
MR HARNATH: Your Honour, I rely on my submission in the Southern States Award earlier and the only matter, of course, of reference is the first pay period to commence on or after 29 August and we are in accord with that. It is consistent with the group of the awards. They were all varied on the same day.
PN12
THE DEPUTY PRESIDENT: Well, it meets the 12 months requirement does it not?
PN13
MR HARNATH: Exactly, your Honour.
PN14
THE DEPUTY PRESIDENT: Right, marvellous. Nothing else? Well, we will deal with that on the same basis which is that the order be issued as sought, unless we locate some issue, which is unlikely. Anything else?
PN15
MR COONEY: Nothing further, your Honour.
PN16
THE DEPUTY PRESIDENT: Thank you very much.
ADJOURNED INDEFINITELY [11.07am]
