THE SENIOR DEPUTY PRESIDENT: Yes, go ahead.

MR McKAY: Yes, Commissioner, I appear on behalf of all parties in the listed matters and a copy of the authorities for me to act on their behalf has been forwarded to the Commission along with form R27. We believe the requirements of section 170LJ have been met as indicated in the statutory declarations accompanying these agreements and each of these agreements has a dispute settling procedure as in clause 12 with a nominal expiry date of 31 October 2005. That is the submissions of the CEPU, electrical division, if the Commission pleases.

THE SENIOR DEPUTY PRESIDENT: Yes, thank you, Mr McKay. These matters are applications for certification of various agreements pursuant to the provisions of the Workplace Relations Act 1996. On the basis of the statutory declarations that have been filed by the parties to the agreements and the submissions that have been made this morning I am of the view that, having regard to the applicable provisions of the Act, I am required to certify the agreements. An appropriate certification will therefore be issued in each matter and each of those matters is adjourned on that basis.
