in regards to the agreement and board of
reference
MELBOURNE
2.16 PM, THURSDAY, 4 NOVEMBER 2004
PN1
MR W. WEST: I appear for the Floor Covering Association. With me is MR J. WHITE, President of the Floor Covering Association and also with me is MR A. MARTIN, General Manager of Aywon Carpets Pty Ltd.
PN2
THE SENIOR DEPUTY PRESIDENT: Yes, Mr West?
PN3
MR WEST: Your Honour, we are here this morning - sorry, this afternoon, to hear the application. We have had discussions with the union who - their solicitor could not wait around until half past two or sorry, 2 o'clock as it is now or quarter past two as it is now - and we have come to an agreement between the parties that we would have a series of at least two meetings starting 15 November to fully thrash out the issues engaged in the Incolink Fund going from, they say going from fund number two into fund number one.
PN4
And we would seek assistance from the Commission through your Honour - a report back meeting some time in early December, maybe the week beginning 13 December, to report on our progress, understanding, your Honour, by that time the decision in the Electrolux case and subsequent decisions will be more clearer and hence section 170LW may be able to apply. I seek your indulgence in hearing the case today because of those decisions and subsequent decisions. So hence that was why we sought a conference with the unions, you know, with the Commission to see if we can progress the matter.
PN5
THE SENIOR DEPUTY PRESIDENT: Yes, very well. Mr West, does 1 o'clock on 13 December suit you?
PN6
MR WEST: Yes, your Honour, it certainly does.
PN7
THE SENIOR DEPUTY PRESIDENT: Very well. I will list this matter for report back 1 o'clock on 13 December 2004 here in Melbourne. Is there anything else, Mr West?
PN8
MR WEST: I do not believe so. No. And thank you, your Honour, for hearing us this afternoon and having a chance for report back.
PN9
THE SENIOR DEPUTY PRESIDENT: Very well. I will adjourn.
ADJOURNED UNTIL MONDAY, 13 DECEMBER 2004 [2.19pm]
