THE D.PRESIDENT: This is an application pursuant to section 170LJ of the Workplace Relations Act for certification of the Port of Devonport Corporation Engineering Enterprise Agreement 2004. The parties to the agreement are the Port of Devonport Corporation Pty Limited and the Maritime Union of Australia. The parties were advised that there were no queries in respect to the content of the agreement and each has provided a fax seeking certification in their absence. They have also provided stat decs in support of the application. The Corporation is a constitutional corporation. The agreement, however, was filed some 44 days out of time. I will exercise my discretion to extend the time for lodging the agreement. I am advised that the documentation had to travel from Devonport to Sydney and somehow, it would seem, got lost on the way. Nevertheless, the agreement will be certified. An order will issue to take effect from today's date and to remain in force until 30 June 2007. That agreement is certified.
