THE DEPUTY PRESIDENT: Thank you very much. Who would like to start?

MR WALL: Thank you, your Honour. Your Honour, this is Gippsland Water's third enterprise agreement made between Gippsland Water, the ASU and APESMA. It contains significant benefits for both staff and for the organisation. We believe that the requirements of the Act have been met and I would rely upon the statutory declaration that has been submitted by Mr Gary Smith, who is the organisation development manager at Gippsland Water.

The parties have been through the agreement with a view to removing any items that might give rise for concern in light of the Electrolux matter and we don't believe there is anything contained in there that would cause any problems and we would simply ask that the Commission sees fit to certify the agreement today with a nominal expiry date of 19 August 2007. If the Commission pleases.

THE DEPUTY PRESIDENT: Thank you very much.

MS BAULCH: Yes, thank you, your Honour. Yes, the Association supports the certification of the agreement before you today. We rely on the statutory declaration of Mr Jeffrey Artis. That statutory declaration outlines how we believe the various requirements for certification of agreement have been met and on that basis we request that you certify the agreement. Thank you, your Honour.

MR McCANDLESS: Yes, thank you, your Honour. We also support the application and rely on the statutory declaration by Darrell Cochrane which is filed with the application and I would seek that the Commission certify the agreement.

THE DEPUTY PRESIDENT: Thank you very much. Thank you for those submissions. On the basis of the submissions put today, the statutory declarations and other documents filed, I will certify the agreement as sought and a certificate will be now provided to the parties. Thank you very much for coming.
