for certification of the Launceston City
Council Enterprise Agreement 2004

THE DEPUTY PRESIDENT: This is an application pursuant to section 170LJ of the Workplace Relations Act for certification of an agreement to be known as the Launceston City council Enterprise Agreement 2004. Parties to the agreement are the Launceston City Council, the Australian Municipal, Administrative and Clerical Services Union and the Association of Professional Engineers, Scientists and Managers Australia. The agreement shall apply to those employees be they members of the unions or not covered by the classifications found in the agreement.

The application was subject to a hearing in Launceston on 8 November at which time there were some clarification sought as to certain provisions in the agreement. The parties have clarified those provisions and some of the wording in the agreement has been changed to make the meaning of the provisions clearer. Accordingly I am satisfied that there is no need for the agreement to go back to the vote as it does not change the intent of the terms of the agreement, it merely clarifies in language that is more user-friendly the issues that I had raised. The clarification and the changes to the words has been done in concert with the unions and the employee representatives.

Accordingly the agreement can now be certified and each of the parties agrees to certification in their absence. I am satisfied also that they have provided the necessary statutory declarations. The agreement was filed in the prescribed time limit. Accordingly an order will issue to take effect from today's effect and to remain in force until 30 June 2007. I note however that the agreement came into effect from 1 July 2004. The agreement is hereby certified and I thank the parties for their assistance in clarifying some of the clauses therein. The matter is adjourned.
