THE DEPUTY PRESIDENT: This is an application pursuant to section 170LJ of the Workplace Relations Act for certification of the Calvary Health Care Tasmania (St Lukes Campus) Nursing Staff Enterprise Bargaining Agreement 2004. Parties to the agreement are Calvary Health Care Tasmania, the Australian Nursing Federation and the Health Services Union of Australia. The campus is a constitutional corporation and the application was filed one day out of time. I exercise my discretion in respect to the late filing. The parties have been advised there are no queries in respect to the content of the agreement. Each has provided a fax seeking certification in their absence. They have also provided the necessary statutory declarations.

Having considered all of those the Commission is of the view that the agreement can be certified. Accordingly an order will issue to take effect from today's date and remain in force until 31 March 2007. That agreement is certified.
