MR M. DE CARTERET: Seeking leave to appear on behalf of the company, Calcorp Services.

THE COMMISSIONER: Yes, thank you. Tell me all about it.

MR DE CARTERET: Commissioner, we would just like to make an application under section 170XF(2) - application for a designated award. In this particular instance, Commissioner, the company is not a party to that award but that's why we're making this application. We believe the Building Services (Victoria) Award is the appropriate award for the industry.

THE COMMISSIONER: Yes, I concur with that. I make a determination pursuant to section 170XF of the Act that the award in respect to the Calcorp Services Pty Limited Certified Agreement 2004-2007 is the Building Services (Victoria) Award 2003.

MR DE CARTERET: Thank you, Commissioner. I would also like to make application under section 170LK for the certification of the Calcorp Services Proprietary Limited Certified Agreement 2004-2007. And the agreement has been prepared and the appropriate processes under the Act have been followed, Commissioner.

THE COMMISSIONER: Yes, thank you. The Commission is content that the requirements of the Act and the rules for the Commission have been met in this application by Calcorp Services Pty Limited to have the Calcorp Services Pty Limited Certified Agreement 2004-2007 certified. Accordingly, pursuant to section 170LT of the Workplace Relations Act 1996 the Commission certifies the said agreement. The agreement is to come into force from today's date, 13 December 2004 and to remain in force until 12 December 2007. The Commission is adjourned, gentlemen.
