MR R. SINCLAIR: I appear for the company in this matter. Mr Madden, the employee representative, apologises to the Commission for non-attendance. Some night-shift at the moment would mean he would be away for about two nights of production. And, your Honour, the statutory declarations have been filed in accordance with the Act and we have asked the Commission to certify the agreement as lodged.

THE SENIOR DEPUTY PRESIDENT: Yes, thank you, Mr Sinclair. Again, I have perused the documentation. I am satisfied that the requirements of the Act, including the no-disadvantage test, have been met. The agreement will be certified to operate from today's date.
