the TESA Resources Pty Limited Civil Building
Construction Enterprise Agreement 2003-2005

THE DEPUTY PRESIDENT: This is an application pursuant to section 170LS of the Workplace Relations Act for certification of an agreement to be known as the TESA Resources Pty Limited Civil Building Construction Enterprise Agreement 2003-2005. The parties to the agreement are TESA Resources Pty Limited and the Construction, Forestry, Mining and Energy Union of Australia, Tasmanian Branch.

None of the parties are present, having been advised that there are no queries in respect to the provisions in the agreement. Each has provided a fax seeking that the agreement be certified in their absence. The parties have also provided statutory declarations and having perused those I am satisfied that the application meets the requirements of the Act and accordingly, the agreement can be certified. An order will issue to take effect from today's date and the agreement will remain in force until 15 October 2005. I note the agreement came into effect on 4 February 2004. That agreement is hereby certified.
