THE DEPUTY PRESIDENT: This is an application pursuant to section 170LS of the Workplace Relations Act for certification of the Liquor, Hospitality and Miscellaneous Union Chemical Industry (Aluminates (Tas) Pty Ltd) Enterprise Agreement 2004. The parties to the agreement are the Liquor, Hospitality and Miscellaneous Union, the Transport Workers Union of Australia and Aluminates (Tasmania) Pty Limited and employees covered by the classifications found in the agreement, be they members of the union or not.

None of the parties to the agreement are in attendance, having been advised that there were no queries the Commission wished to raise in respect to the agreement, and each has provided a fax seeking certification in their absence. The application was filed within the prescribed time limit and is in settlement of a dispute found in matter 03805 of 79. I question the ambit of that, but never mind. Each has also provided the necessary statutory declarations and accordingly I am satisfied that the agreement can be certified and meets the requirements of the Act. An order will issue to take effect from today's date and will remain in force until 1 June 2006. That agreement is certified.
