THE COMMISSIONER: You are seeking leave, are you?

THE COMMISSIONER: Yes. All right. I gather you are not contesting that?

MR BIRD: No, we are not.

THE COMMISSIONER: Thank you. I am happy to grant you leave. Yes, Mr Angelopoulos?

MR ANGELOPOULOS: Commissioner, the parties have had some discussion this morning and I might say the discussions have been fruitful. The matter has been resolved and settled and the terms of the settlement are confidential between the parties but we would like to thank the assistance of the Commission thus far in this matter.

THE COMMISSIONER: Yes, thank you. Thank you very much. Mr Bird, you are happy with that statement?

MR BIRD: We are, sir.

THE COMMISSIONER: Yes, thank you. I am just wondering, Mr Bird, is it appropriate for me at this stage to dismiss the application or are you waiting to document in terms of settlement and should I leave it adjourned?

MR BIRD: I think it should be adjourned and we can notify you when the matter has been - - -

THE COMMISSIONER: If you would, thank you. Once terms of settlement decide, could you notify me within seven days?
