THE COMMISSIONER: Proceedings are resumed and we are on the record and Mr Marasco, I think the ball is in your court.

MR MARASCO: Yes. I am happy to advise the Commission that the parties have reached an agreement. That agreement being that Chubb will employ directly with the contractors who are working for MA Specialised. I am just about to - there is an RDO this Monday but those employees along with the Chubb employees are, so all employees, will commence work on Tuesday. It will take a few days for the paperwork to be finalised in relation to hiring those people as Chubb employees but that should be finished by the end of next week. At that time, Chubb will demonstrate compliance with the EBA and the relevant funds in relation to those employees. If there is any disputes about the matter then we would seek to have it referred back the Commission.

MR BORENSTEIN: That is acceptable to the CEPU, Commissioner.

THE COMMISSIONER: Very good. On that basis, the proceedings are adjourned. They will be re-listed on application from either party so long as that application is made within the next fortnight.
