TRANSCRIPT OF PROCEEDINGS
Workplace Relations Act 1996 12484-1
COMMISSIONER BLAIR
C2005/3449
APPLICATION BY CONSTRUCTION, FORESTRY, MINING AND ENERGY UNION
s.113 - Application to vary an Award
(C2005/3449)
MELBOURNE
9.48AM, TUESDAY, 12 JULY 2005
THE FOLLOWING PROCEEDINGS WERE CONDUCTED VIA VIDEO CONFERENCE AND RECORDED IN MELBOURNE
PN1
MS E SIAMI: I appear for the CFMEU
PN2
MR M SHEEHAN: I appear on behalf of Business SA and we've also been asked to make an appearance for the Glass and Glazing Association for South Australia, if it pleases the Commission.
PN3
THE COMMISSIONER: Thank you. Yes Ms Siami?
PN4
MS SIAMI: Commissioner, this is an application to vary the award in line with the recent safety net review of June 2005 PR002005. It's also an increase of expense related allowances and .....specifically a minimum to ensure shorter hours. The union's submission that the application is consistent with the statement of principles - but the - those specific to the absorption of the increase at least twelve months apart with the rates in the award ..... safety net review and, your Honour, any objections. The only point I'd note is that on the draft order provided to the parties and to the Commission, I think the operative date was the 5 or 6 July.
PN5
THE COMMISSIONER: 6 July.
PN6
MS SIAMI: We would be seeking an operative date from the first pay period on or after today's date.
PN7
THE COMMISSIONER: 12 July
PN8
MS SIAMI: Yes.
PN9
THE COMMISSIONER: Thank you. Mr Sheehan?
PN10
MR SHEEHAN: Thank you sir. Business SA has had an opportunity of examining the draft order presented by the union. We don't have an issue with that particular draft order, but we believe it's consistent with the recent safety net review wages decision before the Commission, and we support the operative date sought, that being the first pay period on or after today's date. I've got nothing further to add, Commissioner.
PN11
THE COMMISSIONER: Thanks Mr Sheehan. This is an application under section 113 of the Workplace Relations Act to vary the Glass Merchants and Glazing Contractors General South Australia Award 1998, to reflect Full Bench safety net review decision in print PR002005. A draft order has been provided with consent of all parties. The Commission is satisfied that the draft order does reflect the safety net review decision. It will therefore vary the award in the terms sought in the draft order, and that shall come into force from the first pay period commencing on or after 12 July 2005, and shall remain in force for a period of three months. Thank you.
