THE COMMISSIONER: Yes, Mr Meli. Ms Ryall?

MS RYALL: Thank you, Commissioner. This is an application for certification of an agreement made under Division 2 of Part VIB of the Workplace Relations Act. Commissioner, all of the requirements of the Act regulation and rules of the Commission have been met in the making of this agreement and we rely on the statutory declaration of John Allen to that effect. Unless you have any further questions of me, Commissioner, we just ask that the agreement be certified from today's date in the terms sought.

MR MELI: K&S supports the application for certification as presented by the TWU.

THE COMMISSIONER: Yes, thanks, Mr Meli. Well, the Commission is satisfied the matter is properly before it, that it has been filed pursuant of the rules of the Commission and the requirements of the Act. And there is nothing in the agreement or contained in the agreement which does not pertain to the employment relationship as defined by the High Court of Australia. Accordingly, K&S Freighters Pty Ltd Transport Employees (Melbourne Full Load) Agreement 2005 is pursuant to section 170LT of the Workplace Relations Act 1996 certified. The agreement shall come into force from today's date 5 August 2005 and it is to remain in force until 31 December 2007. The matter is adjourned. Thank you.
