MS C CHEW: For the Australian Manufacturing Workers Union and at the risk of sounding like a broken record, this agreement is also late by the same amount of time. It was voted on 3 August by a majority of employees who approved the agreement and not lodged until 5 September 2005. As in the previous application I contacted the organiser to confirm that the work force hadn't changed and indeed it hasn't. In all respects we submit that the agreement meets all the requirements of the Workplace Relations Act and Electrolux and on that basis we would ask for the agreement to be certified.

THE SENIOR DEPUTY PRESIDENT: Clause 7.2 refers to appendix A which I think should be appendix 1.

THE SENIOR DEPUTY PRESIDENT: And clause 19 in the disputes settling procedure, the Commission is going to conciliate?

MS CHEW: Yes. I confirm that, your Honour.

THE SENIOR DEPUTY PRESIDENT: For assistance, yes. Okay. Well having regard to the material contained on the file in this matter and also the submissions put to me I am satisfied I should certify the agreement known as the Leslie Maintenance and Pipe Fitting Pty Ltd Collective Bargaining Workshop Agreement 2003. I am satisfied that to do so would be consistent with the requirements of the Act and the regulations. The certification of the agreement will come into force from today's date and remain in force until 31 March 2006 and having regard to those submissions and the material on the file I am also satisfied that the necessary extension of time for the lodgement of the application in the matter should be granted.
