THE DEPUTY PRESIDENT: Also while I have court recording available I want to put on the record another application for certification of an agreement, AG2005/6628. This was listed in Launceston on Tuesday 8 November. Due to a series of misadventures which I won't go into detail about and the inability to arrange for either a teleconference or for the recording of the conference the parties were advised that the agreement would be certified and would take effect from that date ….. court recording.

I want to put that on the record. It is an application pursuant to section 170LJ for certification of the George Town Seafoods Enterprise Agreement 2004. The parties to the agreement are the Maritime Union of Australia and the company George Town Seafoods. The agreement meets the requirements of the Act. The proper process has been followed. The agreement was filed some days out of time. The explanation being due to the logistics and the non availability of the parties to get together for the signing of this document.

Accordingly I have exercised my discretion pursuant to section 111(1)(r) of the Act and extend the time for lodgement. The agreement was to come into effect from the day of the initial hearing which was the 8 November and was to remain in force for a period of three years from that date. Accordingly the George Town Seafoods Enterprise Agreement 2004 is certified. Thank you for that. Those two matters are adjourned.
