THE COMMISSIONER: If we now deal with the Maroondah City Council agreement.

MR R WALL: Thank you, Commissioner. This is Maroondah City Council’s sixth enterprise agreement and we would ask that the Commission sees fit to certify this agreement today. I rely upon the statutory declaration that has been submitted by the council’s chief executive officer, Mr Michael Berasco. I believe the requirements of the Act have been met. There are no award reductions and there are significant pay increases and other benefits to the staff of the council.

MS A LEE: Commissioner, the association supports the application and relies upon the statutory declaration of Mr Geoff Radders and asks the Commission to certify the agreement.

MS M McCANN: Yes, Commissioner, we also support the application and rely upon our statutory declaration by Darrell Cochrane, the branch secretary.

THE COMMISSIONER: Yes, thank you very much. I am satisfied on the basis of the written submissions and the submissions made before
me today that the Maroondah City Council Enterprise Agreement No. 6 2005 meets all the relevant statutory requirements for certification.
I note that the term of the agreement at clause 6 won’t exceed three years. It will be from certification until
30 September 2008. There’s an appropriate dispute resolution procedure clause set out at clause 39. The agreement appears
to contain no disadvantages and indeed it contains a number of advantages, which are set out at clause 15, 16, 17, 20, 26, 28, 31,
and 40. Accordingly, I do certify this agreement today
