MS H RYALL: I appear on behalf of the Transport Workers Union.

THE COMMISSIONER: Yes Ms Ryall.

MS RYALL: Commissioner this is an application section 170LJ of the Workplace Relations Act for certification of the agreement between Toll Priority and the Transport Workers Union. We say that the agreement meets all the requirements of the Act, regulation rules of the Commission except in relation to time for filing. Although the agreement was signed within the 21 day time period it appears to have been lodged a couple of days outside that time. At this point I haven’t been able to confirm whether there’s been a change in the workforce but I’d be happy to do so, hopefully by close of business today. Barring that particular matter we’d ask the Commission to certify the agreement from today’s date.

THE COMMISSIONER: Yes thank you. Well the Commission is content that there would be no change to the workforce given the type of
the employees involved in the agreement. So the agreement to be known as the Toll Priority Port Melbourne Clerical Employees Enterprise
Agreement 2005 is pursuant to section 111(1)(r) of the Workplace Relations Act filed out of time. Pursuant to section 170LT of the Workplace Relations Act 1996 the Commission certifies the said agreement. The agreement shall come into force from today’s date
5 December 2005 and to remain in force until 1 September 2008. The matter’s adjourned thank you the Commissions adjourned,
