THE SENIOR DEPUTY PRESIDENT: Yes. Yes well this matter was adjourned for a report back because there were discussions being held. Could the AEU please report to us what the position is.

MS GALE: Thank you, your Honour. Unfortunately due to a variety of circumstances including perhaps an unhealthy fixation on the new legislation the AEU has been a little tardy in corresponding with the other unions. We have provided some written information for the other unions just this week in relation to the shape of the rule and the direction that we believe we can go in, in terms of refining it to meet the concerns of objectors. Obviously because of the lateness of that correspondence we have not yet received a reply from the objector unions and in the circumstances we would seek further adjournment perhaps until the second half of February. Thank you, your Honour.
