MR R RONDINELLI: Of the Australian Industry Group and I appear on behalf of Australian Air Express Pty Ltd.

MS H RYALL: I appear for the Transport Workers' Union in this matter.

THE COMMISSIONER: Yes Ms Ryall. Mr Rondinelli?

MR RONDINELLI: Thank you sir. The first application before you is an application to terminate the Off Airport Business Development (AAE/TWU) 2004 Certified Agreement and Commissioner in accordance with such an application a statutory declaration indicating the facts to establish a basis for the Commission to be satisfied that a valid majority of the employees whose employment is subject to the agreement at the time genuinely approved its termination and a written statement by the company and union have been provided in accordance with section 170MG(3).

The company seeks to rely upon the documentation filed in this matter and request that the Commission terminate the agreement. If the Commission pleases.

THE COMMISSIONER: Yes thank you. Ms Ryall?

MS RYALL: Thank you Commissioner. We support the submissions of Australian Air Express's representative here today and we would ask that you terminate the agreement in accordance with the application.

THE COMMISSIONER: Yes thank you. Well the Commission is content that the rules of the Commission have been followed in this application and that the application follows the requirements of the Act and that the said statutory declarations and other information are attached to the file and meet the requirements of the Act. Accordingly pursuant to section 170MG of the Act the above agreement is hereby terminated. The agreement is the Off Airport Business Development Agreement (AAE/TWU) 2004. The order comes into force from today's date, 14 February.
