THE SENIOR DEPUTY PRESIDENT: The next matter is C2005/6248. It is an application by APESMA in respect of the Technical Services Architects Award 2000.

THE SENIOR DEPUTY PRESIDENT: Ms Wise?
MS WISE: Thank you, your Honour. The time, date and place of the hearing and a copy of the application was served on the parties respondent to the award. Subsequently a draft order has also been circulated to the parties respondent to the award. Your Honour, at this stage I will formally table the draft order.

MS WISE: Thank you. The draft order in the association's view reflects the Commission's Family Provision decision of August 2005 print number 082005 incorporating the personal leave, bereavement leave, annual leave and parental leave variations accordingly. The proposed operative date for this variation is from today, 15 February 2006. Your Honour, that concludes the association's submission.

MR EBERHARD: Thank you, your Honour. VECCI has had the opportunity of reviewing the draft order and as a consequence of that we would not be opposing the application made here today by the association. If the Commission pleases.

THE SENIOR DEPUTY PRESIDENT: Very well. Well having regard to the material contained on the file in the matter and the submissions put to me I am satisfied I should vary the award in accordance with APESMA1. The variation will come into force from the first full pay period to commence on or after 15 February 2006 and remain in force for a period of six months.
