THE COMMISSIONER: There are no appearances from either party in respect to this application. The Commission has received correspondence from Brambles which supports the certification of the agreement. Also it gives an explanation for the matter being lodged out of time and most importantly says there has been no change in the workforce. Accordingly pursuant to section 111(1)(r) the Commission extends the time of hearing of the matter and is satisfied that in other respects the agreement was lodged pursuant to the rules of the Commission and meets the requirements of the Act and most importantly contains nothing which would place it at odds with any decision of the High Court of Australia about matters which can be in agreements.

Accordingly pursuant to section 170LT of the Workplace Relations Act 1996 the Commission certifies the Cleanaway Pilbara (Karratha & Port Hedland) Certified Agreement. The agreement shall come into force from today's date, 3 March 2006 and remain in force until 31 December 2008.
