MR M BOWER: I appear for the Transport Workers' Union of Australia in this matter Commissioner.

THE COMMISSIONER: Yes Mr Bower.

MR BOWER: Thank you Commissioner. This is an application to vary the Wesfarmers Kleenheat Gas Pty Ltd Transport Workers' Award 2000. If you could just bear with me, Commissioner, I will just sort out my paperwork here because it is starting to get a bit messy. Commissioner, this application is simply to insert the test case standards set out in the Family Provisions decision which was set out at PR082005. In relation to the matter I would hand up to the Commission a copy of a statement as to service and also the union's draft order in this matter.

THE COMMISSIONER: Thank you. Yes?

MR BOWER: Commissioner, in relation to this matter I have had no correspondence or phone calls from any of the parties served on the substituted service order and so the union would submit that the order be issued in the terms sought. If the Commission pleases.

THE COMMISSIONER: There being no opposition from any party the Wesfarmers Kleenheat Gas Pty Ltd Transport Workers' Award 2000 is varied in the terms of the draft order tendered. The order will come into operation beginning the first pay period which commences on or after today's date, 14 March 2006 and shall remain in force for a period of six months.
