THE COMMISSIONER: Ms Fernandez. You're there, Mr Burke, I take it?

MR BURKE: Yes, Commissioner. Good morning.

THE COMMISSIONER: Good morning. Ms Fernandez?

MS FERNANDEZ: Thank you Commissioner. As I understand - - -

THE COMMISSIONER: Given that Mr Burke is no doubt sitting down, you can sit down as well if you wish to address me.

MS FERNANDEZ: Okay. Thank you. I was wondering whether they stood up when you walked in. As I understand it, this issue has been somewhat resolved in that the workers have had their breaks made quite regular and are only changing them on an ad hoc basis, on a needs basis and I haven't had a chance to speak to the workers. I would be interested to hear from the company. The company were intended to contact me so I could speak to the workers and get a final decision on how they are feeling about this and other issues, but I am still waiting for the company to contact me to organise a meeting. If we could possibly get some dates today then I am happy to discontinue this matter as had been resolved.

THE COMMISSIONER: Yes. Look I think this matter has come to its natural conclusion. There certainly won't be the vehicle for other matters excluding breaks. I know you haven't had time to talk to your members but I would take it they would talk to you if they were significantly upset or whatever.

MS FERNANDEZ: Yes they certainly would speak to myself or Mr Muscat. At this present moment in time they are, you know they are not 100 per cent happy. They would have preferred for things to have stayed the way they are but now that we have stabilised the breaks.

THE COMMISSIONER: Yes.

MS FERNANDEZ: They are a lot happier than what they were a few weeks ago.

THE COMMISSIONER: Well nobody is ever 100 per cent happy in my experience, including myself from time to time. So if you want to set meetings with Mr Burke and use this as a vehicle for doing it, by all means do so.

MS FERNANDEZ: Well I have got my diary if they have got their diary there and if they can give me a date for next week. We were supposed to have - - -

THE COMMISSIONER: We'll just go off the record for a moment while we chat about this.

THE COMMISSIONER: The parties are welcome to use the facilities of the Commission and the telephone link to set up their meeting about another matter, but in my view the file before me, matter 1759 is concluded. Do you agree with that?
