MR PARRY: If the Commission pleases, the remaining evidence from the Health Services was to comprise further witness evidence. We advise the Commission that in respect of Mr Wallace we don't rely on his statement, and we would tender the attachment to that statement which is a document being a policy manual, Industrial Relations Policy Manual for the Victorian Public Sector 2006.

MR PARRY: If the Commission pleases, there are some other documents we'd tender, but before dealing with those, Ms Keenan and Ms Grattan-Vaughn are not available today. Ms Keenan, we would hopefully be able to speak to my learned friend about the evidence which she would give in her witness statement, and given the general line of questioning and the responses it may well be that upon instructions from Ms Keenan to make concessions which will make the calling of her unnecessary.

The position of Ms Grattan-Vaughn is a little more complicated in that the Commission might recall there was much oral evidence given by Ms Cariss, who was a speech therapist, in areas such as assisting surgeons and so forth which, on our instructions, was a little bit more than we understand the position of speech therapists to be. We have proposed calling Ms Grattan Vaughn to deal and lead some further oral evidence regarding the oral evidence of Ms Cariss.

Now, it is unlikely, but I suppose not beyond the realms of possibility that we may be able to agree some concessions with regard to that, but it may be a little more difficult given our instructions, and in that circumstance it may be necessary to call Ms Grattan-Vaughn to give evidence before the final submissions are made. Now, we don't oppose that being heard by one or more members of the Full Bench if it to be in the week of 5, 6 or 7 November we don't - whilst that might be very close to the hearing of the submissions, as I think the Commission would intend, it might be that her evidence is given immediately before the submissions. Alternatively, the Commission might want to fix another date between here and then to take that oral evidence.

Now, as is the way of the world, Ms Grattan-Vaughn is going overseas at some stage and her chief executive officer has just resigned, which makes it a little difficult to arrange times with her. So that - - -

MR PARRY: She's going overseas from 18 to 29 October. She has some available dates before then, perhaps this Friday in the afternoon, or 31 October in the afternoon. Now, I haven't had any discussions with Ms Vaughn. Those are my instructions as to her available dates, or the 5th perhaps of November, which is one of the dates the Commission was flagging.

If we were to have her evidence on the 5th and 6th - I think Mr Langmead said he's not available on the 5th anyway - if we were to have her evidence on the 6th is there any reason why we couldn't proceed with a program for written submissions between now and then subject to her evidence being dealt with by way of oral submissions?

MR PARRY: No reason. Now, that leaves a number of documents we would seek to tender. If the Commission pleases, I can proceed with that if now is a suitable time.

MR LANGMEAD: Your Honour, I suppose it's somewhat unsatisfactory ..... test their evidence at a very late stage in the proceedings. I understand the point that Mr Parry makes in relation to the evidence of Ms Cariss. A number of the responses of Ms Grattan-Vaugh were put to Ms Cariss in cross-examination. I suppose our main concern is that we don't suffer any delays in bringing this matter to finality, and so if the Commission's minded to seek that process we would be - it's a matter for the Commission.

MR PARRY: We would tender a CPI comparison document which we have prepared. I've handed up to the Commission a document headed CPI Increases from September 2007 Quarter Until June 2008. There is a front page which is a summary page prepared by us, and attached to that are various Australian Bureau of Statistics documents.

Now, the Commission will have heard of the existence of independent hospitals, then the development of various networks, and then the creation of the health services as is currently the position. And this document headed Development of Metropolitan Health Services attaches various government gazettes which deal with that development over time.

Also if I could tender and hand up I probably at this stage, just so that we don't have to carry it back, rather the generous resources of the Commission.

Commissioner, you asked if we could provide information of the relative value of the graduate entry rate of pay, the real increase in the value of the graduate entry rate of pay and a comparison of the rate of growth as a real value of the classification rates of pay. Those assisting the unions have asked that I clarify what you meant by the graduate entry rate of pay. Was it a graduate entry rate of pay peculiar to this industry or, as I'm instructed, there are statistics going to graduate entry rates of pay generally.

COMMISSIONER LEWIN: There is quite a broad range of statistics concerning graduate entry rate because there are graduate entry rates in numerous industries, particularly in the public sector. I had in mind this particular industry.
